Questions & answers§ FAQs

Everything you’d ask us first.

The questions founders and counsel raise most often, answered plainly. If yours isn’t here, the consultation is free — just ask.

Getting started
Is the first consultation really free?+

Yes. The discovery call is a genuine 30-minute conversation with a partner at no cost and with no obligation to engage us afterwards. If we are not the right fit, we will say so and, where we can, point you somewhere better.

Who actually handles my matter?+

A named partner owns every file and signs every substantive piece of advice. Associates support the work, but you are never handed off to a faceless queue, and you always know who to call.

How do I get started with you?+

Begin with the free 30-minute discovery call — book it from the consultation page, call us, or message us on WhatsApp. Tell us your brand, what you sell and where you trade, and we will map the shortest, safest route to protection before you spend a rupee.

What should I have ready before the first call?+

Whatever you have is enough. Ideally: the exact name or logo you want to protect, a one-line description of your goods or services, and any markets you are eyeing beyond India. If you already have a filing or a notice, share the number — we will look it up in advance.

Trademarks
Do I need a trademark search before I file?+

We strongly recommend it. Filing blind risks an objection, an opposition, or building a brand on a mark you cannot defend. A clearance search is a few days and a modest fee against the far larger cost of refiling or rebranding.

How long does registration take in India?+

An unopposed application is typically registered in 8–14 months: examination within a few months of filing, then a four-month journal-advertisement window, then issuance. Objections or oppositions extend this, which is exactly why clearance and prosecution strategy matter.

What is the difference between an objection and an opposition?+

An objection is raised by the Trade Marks Registry itself during examination — usually on distinctiveness or prior conflicting marks. An opposition is filed by a third party after your mark is advertised in the journal. We respond to both; they call for different arguments.

How long does a registration last?+

A registered trademark in India is valid for ten years from the date of filing and can be renewed indefinitely in further ten-year terms. Our portfolio service ensures a renewal is never missed.

Can I use the ™ and ® symbols on my brand?+

You may use ™ at any time to signal that you claim a mark, even before filing. The ® symbol is reserved by law for marks that are actually registered — using it prematurely is an offence. Once your certificate issues, we confirm exactly where and how to display ®.

What happens if my application receives an objection?+

An examination objection is common and rarely fatal. We analyse the ground raised, draft a reasoned reply with evidence of distinctiveness or use, and appear at the hearing if one is set. Most well-prepared applications clear examination; you are told candidly if the odds are against yours.

Protection & scope
What are trademark classes and how many do I need?+

Goods and services are divided into 45 classes under the NICE classification. You file in the classes that match your actual and intended business. We help you avoid both under-filing, which leaves gaps, and over-filing, which wastes fees.

Can I protect my brand outside India?+

Yes — through the Madrid Protocol from a single application, or via direct national filings using our vetted agent network in over 70 jurisdictions. We coordinate strategy, cost and deadlines from one desk.

Do you handle copyrights, designs and patents too?+

Yes. Alongside trademarks we file and prosecute copyrights and industrial designs, and we coordinate patent matters with our technical associates. Most brands need a layered strategy — a word mark, a logo, a design registration — and we assemble it so nothing is left exposed.

Someone is copying my brand — what can you do?+

Move quickly and we can move quickly with you. Depending on the facts we issue a cease-and-desist, file an opposition or rectification, record your mark with Customs to stop counterfeit imports, or seek an injunction. The first free call is the fastest way to get a clear read on your options.

Fees
How do your fees work?+

We quote fixed professional fees for defined work — search, filing, a response — so you are never surprised. Government fees are passed through at cost. Retainer clients receive a blended monthly rate for portfolio and watch work.

Do you offer plans for startups and small businesses?+

We do. Early-stage founders can spread search, filing and first-year watch into a staged plan, and retainer clients receive a blended monthly rate across their portfolio. We will always tell you what is essential now and what can safely wait.

Working with us
How will you keep me updated on my matter?+

You get a named partner, a single docket and proactive updates at every real milestone — filing, examination, journal advertisement, registration. You never have to chase us for status, and you can always reach us by phone, email or WhatsApp between updates.

Can we work together if I am outside Karnal or outside India?+

Absolutely. Most of our clients work with us entirely remotely, over call, email and WhatsApp, with documents exchanged securely online. We act for founders and counsel across India and, through our agent network, in more than 70 jurisdictions abroad.
